New Mexico sells tax deeds but does not sell tax liens. Interestingly, the current law can allow mortgages to remain on the property even after the tax deed is sold. I suggest that you contact county Clerk to determine if properties are available in a particular county. Listings can be found by contacting each county taxation department or the state Taxation Department. I strongly recommend that you perform ample research and speak with an attorney in New Mexico that has knowledge regarding these sales. I have not invested in New Mexico and I am not fully abreast of the different legal issues that could affect the investor. Texas is a neighboring
state that has very concrete and well established laws so it may be another option for the New Mexico investor.
NOTE: In all tax deed states research is very important. This is because the possibility of land ownership is very high. You should begin reading the state statutes relating to property taxes and delinquent tax collection practices. It is very important to be fully aware of which liens will survive the sale and foreclosure of the deed. The new owner of the parcel will be responsible for any surviving liens and claims attached to the property.
